MINUTE ENTRY AND ORDER: A Telephone Conference was held on August 21, 2026 before Magistrate Judge Peggy Kuo. Christopher Cook, Esq. and Jonathan Marks, Esq. appeared on behalf of Plaintiffs. Andrew Bronsnick, Esq. Samantha Fasnello, Esq. appeared on behalf of Defendants Yan Moshe, Hackensack Specialty ASC LLC, Integrated Specialty ASC LLC, SCOB LLC, Citimed Surgery Center LLC, NJMHMC LLC, Star Solution Services Inc., Reuven Alon, Medaid Radiology LLC, Columbus Imaging Center LLC, Beshert Corp., Nizar Kifaieh, M.D., and Premier Anesthesia Associates P.A. (collectively, "Moshe Defendants"). Thomas Leghorn, Esq. appeared on behalf of Defendants Regina Moshe, Citimedical I PLLC, Citimed Services, P.A., Citimed Services, P.C., and Citimed Complete Medical Care P.C. (collectively, "Citimed Defendants"). Robert Hewitt II, Esq. appeared on behalf of Defendants Vadim Dolsky and Optimum Health Acupuncture P.C., and non-parties All Star Services Inc. and Five Star Services Inc. (collectively, "Dolsky Defendants").
The parties were heard on issues in their 762 763 764 joint submissions, and the Court made rulings on the record.
762 Dolsky Defendants
Plaintiffs and the Dolsky Defendants are directed to confer and resolve outstanding issues regarding privilege logs and inspection of the gold bars, which will occur at two locations, but sequentially on the same day.
763 Citimed Defendants
The Citimed Defendants are directed to complete production of WhatsApp messages for the first set of four custodians by August 28, 2026 and the second set of seven custodians by September 18, 2026.
No later than August 25, 2026, Citimed Defendants must (1) confirm whether they have any billing data for the 27 patients, regardless of whether payments were made to Plaintiffs or to other insurance providers; and (2) produce patient records for the one patient.
Plaintiffs and Citimed Defendants are directed to confer regarding Citimed Defendants' privileged designations involving Mr. Moshe. Citimed Defendants are directed to clarify whether the privilege designations relate to attorney-client communications, joint defense, common interest, or any other assertion of privilege, as well as to describe the lawyers involved, purpose of representation, and relevant transaction or litigation.
No later than September 4, 2026, Plaintiffs shall produce a revised privilege log that describes the bases for each privilege designation, such as attorney-client communications or attorney work product. The parties are reminded that the attorney-client privilege is not limited to anticipated litigation.
764 Moshe Defendants
Plaintiffs are directed to provide Moshe Defendants with any missing fields for patient data no later than August 24, 2026. No later than August 28, 2026, Star Solution is directed to confirm whether it has any billing data for all patients whose treatments are at issue or provide an explanation for its unavailability, and by September 11, 2026, to confirm a date by which it will produce that information.
Moshe Defendants are directed to produce the outstanding lease agreement and a revised privilege log by September 11, 2026.
No later than August 28, 2026, Moshe Defendants are directed to confirm whether there are any additional WhatsApp messages and, if so, to provide a date by which they will be produced.
