Order on Motion for Leave to File
PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendant Luv Car Wash Group, LLC's Motion for Leave to File Third-Party Complaint Against Rinsed, Inc. 17 . Therein, Defendant requests to implead Rinsed, Inc. so that, "in a single proceeding, the Court may adjudicate Rinsed's contractual and common law liability to Luv Car Wash for any judgment Plaintiff may obtain." Id. at 1-2. Plaintiff does not oppose the Motion. Id. at 3. Under Federal Rule 14(a), a defending party may bring in a third-party defendant "who is or may be liable to [the defendant]for all or part of the claim against it." Fed. R. Civ. P. 14(a)(1). The Court finds that Defendant's proposed third-party action against Rinsed arises out of the same transaction or occurrence as the underlying action, and that Defendant is properly invoking Rule 14 because its proposed action against Rinsed is for indemnification. See Fed. R. Civ. P. 14(a)(3); see generally (ECF No. 17-1) (bringing in Rinsed under claims for common law and contractual indemnification for Defendant's liability to Plaintiff). Accordingly, UPON CONSIDERATION of the Unopposed Motion, the pertinent portions of the record, and being otherwise advised of the premises, it is hereby ORDERED AND ADJUDGED that Defendant's Motion 17 is GRANTED.
