Order on Motion to Dismiss
TEXT ORDER: This matter comes before the Court upon review of its docket. On October 27, 2023, Defendants filed a motion to dismiss pro se Plaintiff's Complaint (ECF No. 1 ), which is pending consideration before the Undersigned (ECF No. 6 ). On April 30, 2024, Plaintiff filed a motion for leave to file an amended complaint, which is now pending consideration by the Honorable Rukhsanah L. Singh, U.S.M.J. (ECF No. 12 .) Should Plaintiff's motion be granted, Plaintiff's amended complaint will supersede the original Complaint and become the operative pleading. See Garrett v. Wexford Health, 938 F.3d 69, 82 (3d Cir. 2019) (citations omitted) ("an amended pleading supersedes the original pleading and renders the original pleading a nullity"). Accordingly, the Court administratively terminates Defendants' motion to dismiss pending Judge Singh's consideration of Plaintiff's motion. Should Plaintiff's motion be granted, Defendants may file a new motion to dismiss Plaintiff's amended complaint or may file a request that the Court consider its previous motion as applied to the amended complaint. Should Plaintiff's motion be denied, Defendants' motion to dismiss will be reinstated.So Ordered by Judge Michael A. Shipp on 5/2/2024. (eh, )
