MINUTE entry before the Honorable Young B. Kim: Plaintiffs' amended motion for leave to serve supplemental written discovery 213 is denied. As for Plaintiffs' proposed document requests to be served on Defendant Fat & Broke, Inc. ("FBI"), (R. 213-5), FBI is correct that these are duplicative of their previous requests. (See R. 214-3, Request No. 5; R. 214-4, Request Nos. 3, 6, 7, 8, 30 & 45.) The scope of the previous requests is broad enough to include the documents Plaintiffs now seek in their proposed document requests. As for Plaintiffs' proposed document requests to be served on Defendant Flash Truck Lines Corporation ("FTLC"), (R. 213-8), FTLC is correct that the proposed request Nos. 2-4 are duplicative of their previous requests. (See R. 215-1, Request Nos. 3, 12 & 16.) FTLC is also correct that Plaintiffs have not explained the relevance of the documents they seek in request No. 1 because according to Plaintiffs' theory of statutory employer rests on FBI's contractual right to act as a broker as to the load in question. For these reasons, the motion is denied. That said, FBI is advised that it is barred from offering responsive discovery documents not produced as evidence in this case, unless timely produced under Rule 26(e). Parties are reminded that their next joint status report is due by May 22, 2024. (See R. 208 ("Parties are to file a joint status report by May 22, 2024, and identify other fact depositions they still require, including any medical depositions, and advise the court whether the parties require expert discovery.").)
