ORDER: For the reasons set forth in the attached Opinion and Order, the following motions are granted: 1) the Judicial Defendants' motion to dismiss (ECF No. 39 ) under Federal Rules of Civil Procedure 12(b)(1), 12(b)(2), 12(b)(5), and 12(b)(6);2) the MLG Defendants' motion to dismiss (ECF No. 41 ) and the Pressler Defendants' motion (ECF No. 42 ) under Rule 12(b)(6); and 3) Theresa OBrien's motion to dismiss (ECF No. 44 ) under Rules 12(b)(1) and 12(b)(6) .The Amended Complaint is dismissed in its entirety as to the aforementioned Defendants.Hernandez shall serve the following Defendants by October 2, 2026 in accordance with the requirements of Rule 4, Fed. R. Civ. P.: Wells Fargo Bank, N.A., Woods Oviatt Gilman LLP, Lauren Russo, Richard Mullen, Encore Capital Group, Inc., Midland Credit Management, JP Morgan Chase Bank, Wells Fargo and Company. By October 9, 2026, Hernandez shall file a document demonstrating that service was accomplished. Failure to accomplish service by October 2, 2026 will result in dismissal of all claims against these Defendants under Rule 4(m). Ordered by Judge Nusrat J. Choudhury on 9/20/2026. (JAG)
