NOTICE of Voluntary Dismissal of Plaintiff by Tamieca I. Tobierre (Tobierre, Tamieca)
Order
ORDER re: 74 Notice of Voluntary Dismissal. Plaintiff indicates that she intends to withdraw her claims against "iol [sic], Yale New Haven Health, Community Health Services, and Trinity Health Partners & UConn Health." ECF No. 74 . The Court construes this as a Notice of Voluntary dismissal as against Defendants Institute of Living, Yale New Haven Hospital, and University of Connecticut Health Center. The Clerk of Court is directed to terminate these Defendants.
As to Defendant Community Health Services (CHS), CHS is no longer a party because the Court, on motion of the United States, substituted the United States for CHS as a party Defendant. Thus, a purported withdrawal of claims against CHS is of no effect. However, Plaintiff's efforts to dismiss claims originally brought against CHS raises a question as to whether Plaintiff intended to withdraw her claims against the United States, which arise from her treatment at CHS. On or before June 25, 2026, Plaintiff shall file a Notice indicating whether her purported withdrawal of claims against CHS was an effort to withdraw claims against the substituted party, the United States.
As to "Trinity Health Partners," there are multiple remaining Defendants who Plaintiff might be referring to: Trinity Health NE Corp, Trinity Health of NE Provider Network Org Inc., Trinity Health of NE Corporation Inc. New England, and Trinity Health Provider Network, Inc. In the Notice referenced above, to be filed on or before June 25, 2026, Plaintiff shall also indicate against which of these Defendants she intended to withdraw her claims.
