Order on Motion for Magistrate Judge
TEXT ORDER: The Court is in receipt of plaintiffs' supplemental affidavit dated 7/20/26 (Dkt. 63 ), and defense counsel's letter and affidavit dated 7/24/26 (Dkt. 64 ), both of which concern unrecorded telephone conferences before the Administrative Law Judge. Under the circumstances, the Court will accept both parties' affidavits (and the accompanying submissions), and will consider them, to the extent the Court deems appropriate, in connection with the parties' summary judgment motions. Accordingly, the parties shall continue with their summary judgment briefing in accordance with the agreed-upon schedule. So Ordered by Magistrate Judge J. Brendan Day on 8/3/2026. (cry)

Text Order: With regard to the claims against the State, the parties shall continue to meet and confer regarding the use of the materials produced in the C.P. class action in this litigation. The parties shall file a stipulation regarding the use of those materials by November 3, 2026. If the parties truly cannot reach an agreement, then there should be a joint letter submitted by that date with each side's position and any legal or factual support.
