TEXT ORDER: The Court has reviewed Plaintiff's "Motion to Seal her Motion holding Defendant, David R. Edenbaum, DMD, in contempt for failing to comply with the Order of the Court dated October 4, 2023". (ECF No. 243). This matter was closed and dismissed with prejudice by Order dated December 6, 2022, (ECF No. 239), and the Court did not retain jurisdiction over the settlement. Therefore, there is no presently pending action in which Plaintiff can properly file the Motion and Plaintiff's Motion is hereby DENIED and DISMISSED for lack of jurisdiction. Alternatively, to the extent Plaintiff's Motion could be construed as a motion pursuant to Fed. R. Civ. P. 60, it fails to meet the criteria for such relief as Plaintiff fails to state a substantive basis for vacating the Court's prior dismissal with prejudice. To the extent Plaintiff seeks to vacate or modify the prior dismissal, Plaintiff shall file an appropriate motion to vacate under the Federal Rules of Civil Procedure, supported by a detailed certification and letter brief setting forth a legitimate basis to do so supported by sufficient facts and law. Finally, to the extent Plaintiff seeks to seal the Motion, (ECF No. 243), Plaintiff must file an appropriate motion to seal pursuant to this Court's Local Civ. R. 5.3.
