Order on Motion to Continue
** TEXT ONLY ORDER ** Defendants American Structures, Inc. (ASI) and American Engineered Tanks, LLC (AET) moved to extend the dispositive motion deadline approximately six weeks from June 17 to August 28. Dkt. 39 . For reasons, they state that they need additional time to investigate insurance coverage obligations. Specifically, they note that Cincinnati Specialty Underwriters (CSU), the issuer of an insurance policy to AET, was granted leave to intervene in April. They also assert that CSU's "sister company" issued a similar policy to ASI and that the application of these two policies will need to be addressed. The court moves deadlines for good cause only, and these reasons do not provide good cause. The policies referenced are ones held by defendants, so they have been in their possession since the case schedule was put in place in October 2025. And CSU was brought into the case over two months ago, providing sufficient time to adjust for its presence and take at least one round of written discovery. The court needs to leave sufficient space between the filing of dispositive motions and trial to allow time to rule on the motions. It will not shorten this time absent a good reason, and it did not find one on this record. For these reasons, the motion is DENIED. All deadlines remain in place. Signed by Magistrate Judge Anita Marie Boor on 6/22/2026. (voc)
