ORDER denying 550 Motion to Release JERS Exhibits.Plaintiff's motion for an order directing the Clerk to release JERS data is denied. First, the Exhibit and Witness List appears at ECF No. 547 and is an accurate list of the exhibits that were either admitted as full exhibits at trial or marked for identification only at trial. The Exhibits Log list that appears at ECF No. 547-1 is an accurate list of exhibits that were admitted as full exhibits and provided to the jury to view during deliberations using JERS. Before the jury began deliberations, the court gave the parties the opportunity to review the Exhibits Log that appears at ECF No. 547-1. Indeed, the court delayed the start of jury deliberations after Plaintiff stated she had concerns surrounding the formatting of one exhibit and permitted Plaintiff to watch as the Courtroom Deputy re-uploaded the exhibit into JERS. The court allowed the jury to commence deliberations only after Plaintiff's concerns were addressed and Plaintiff signed the Exhibits Log. See ECF No. 546 , at 5-14. In short, Plaintiff cannot in good faith assert that she lacked notice or opportunity to verify the exhibits that were uploaded into JERS before the jury began deliberations.Second, as the court explained on several occasions throughout trial, exhibits that were marked for identification only were not admitted as full exhibits and not uploaded into JERS for use by the jury during deliberations. Third, although Plaintiff suggests otherwise, see ECF No. 550, at 2 para. 10, neither the attorneys nor the parties may access JERS directly. Finally, Plaintiff already has electronic copies of all exhibits that were uploaded to JERS. Indeed, all but three exhibits were provided by Plaintiff to the court, and Defendants provided copies of their three exhibits to Plaintiff. Thus, Plaintiff does not require access to the JERS data to prepare post-verdict motions.For these reasons, Plaintiff's motion is DENIED.Signed by Judge Sarah F. Russell on 10/5/2026.
