TEXT ORDER denying Defendants' 57 motion in limine without prejudice and with leave to refile pending the Court's decision on Defendants' 55 and 56 motions for summary judgment. Defendants ask the Court to issue an Order "prohibiting [Plaintiff] from presenting the lay or opinion testimony of Robert Deering as to [Plaintiff's] potential damages" or "presenting any damages evidence as set forth in Exhibit 12 of the Deering deposition." [Doc. 57 at 1.] If some or all of Plaintiff's claims survive summary judgment, the Court will issue a trial notice setting forth all relevant trial-related deadlines, including a deadline for the parties to file motions in limine.
