ORDER: The Court is in receipt of the parties' Joint Discovery Dispute Statement [Doc. 13]. As to the labeling of confidential exhibits, the Court understands Defendant to represent that "readability, OCR, or searchability" concerns "can be addressed through the watermark's placement or opacity." Id. at 5. Since these concerns can be addressed while a watermark is used, the Court will allow use of a watermark. Plaintiff can raise any issues caused by watermarks with the Court. As to metadata, the Court is mindful that Rule 26(b) limits the scope of discovery to matters relevant and proportional to the needs of the case. In the Court's view, original file path data for all electronically stored information likely exceeds the necessary scope of discovery, and the parties should confer regarding specific documents for which such data is particularly relevant and should be produced.
