TEXT ORDER: This matter comes before the Court upon Plaintiff's Motion for Default Judgment against Defendant Borough of Sayreville. (ECF No. 29 .) In accordance with Federal Rule of Civil Procedure 55, Plaintiff must obtain an entry of default from the Clerk before seeking a default judgment from either the Clerk or the Court. See Martino v. Comm'r of Soc. Sec., Civ. No. 19-10999, 2019 WL 13398949, at *1 (D.N.J. Sept. 23, 2019) ("The Court finds Plaintiff's motion to be deficient because under Federal Civil Procedure Rule 55, obtaining a default judgment is a two-step process... [and] [the p]laintiff has by-passed the first step of the process."). On July 13, 2026, the Clerk's Office advised Plaintiff that his Request for Default regarding Defendant Borough of Sayreville, (ECF No. 27 ), "cannot be granted as requested because service was improper." Accordingly, Plaintiff's Motion for Default Judgment against this Defendant is premature. The Clerk's Office is directed to TERMINATE the Motion pending at ECF No. 29 . Plaintiff may request to have this Motion returned to the Court's active docket upon entry of default for Defendant Borough of Sayreville. So Ordered by Judge Georgette Castner on 7/14/2026. (jmh)
