MINUTE ENTRY AND ORDER: A Status Conference was held before Magistrate Judge Peggy Kuo on June 29, 2026 by video. Kyle Tramonte, Esq., Todd Toral, Esq., William Goldstein, Esq., Andrew Lichtman, Esq., Kathryn Bolas, Esq., Lee Wolosky, Esq., Alisha Mathew, Esq., and Amal Clooney, Esq. appeared on behalf of Plaintiffs. David Bowker, Esq., Jonathan Paikin, Esq., Erin Hughes, Esq., and Michaela Wilkes Klein, Esq. appeared on behalf of Defendants. No other appearances.
The parties are directed to confer to finalize a protocol for collecting Plaintiffs electronically stored information, which includes agreement on the scope of the term incident, Plaintiffs modes of communication, and search terms and time parameters appropriate to Plaintiffs injuries and experiences.
The Court denied Defendants request for Plaintiffs updated records reflecting the current status of their injuries or certification that the injuries have not changed. Plaintiffs have an obligation to supplement or disclose their disclosure or response in a timely manner if they learn[] that in some material respect the disclosure or response is incomplete or incorrect, and if the additional or corrective information has not otherwise been made known to the other parties during the discovery process or in writing. See Fed. R. Civ. P. 26(e)(1)(A). Failure to do so could result in sanctions. See Fed. R. Civ. P. 26(g)(3).
The parties agreed to conduct 25 third party depositions. The parties are directed to confer about the appropriate number of Plaintiff depositions based on injuries, families or other reasonable categories. If the parties are unable to agree, they shall file a joint letter, of no longer than 5 pages for each side, by 12:00 pm on July 7, 2026, setting forth their respective positions on the number of Plaintiff depositions.

A status conference concerning the number of Plaintiff depositions and any privilege issues is scheduled for July 8, 2026 at 11:00 a.m. before Magistrate Judge Peggy Kuo by video.
The parties are directed to file a joint status report no later than 5:00 pm on July 23, 2026, outlining the progress of discovery. If there are unresolved discovery issues that need to be raised, the parties must clearly and succinctly set out their positions on each disputed issue in the joint status report. The joint status report is limited to a chart outlining the issues and two pages for each side on each disputed issue.
A status conference regarding any outstanding discovery issues is scheduled for July 30, 2026 at 9:30 a.m. before Magistrate Judge Peggy Kuo by video.
Links to access these Zoom meetings will be provided to counsel separately. The parties are directed to log onto the platform at least 10 minutes before the start of the conference. Only counsel who have filed notices of appearances two business days before the conferences may appear on the record.

If the parties require judicial intervention prior to the July 30, 2026 Status Conference, they are directed to file a two-page joint letter detailing their positions for each disputed issue.
The Court granted Defendants request for extension of fact discovery in part. The fact discovery deadline is extended to November 10, 2026.
