SCHEDULING ORDER: The parties shall appear for in-person oral arguments on the pending motions to dismiss Alixs Amended Complaint, ECF Nos. 328 & 332, on Wednesday, May 29, 2024, at 3:15 p.m., in Courtroom 1105 of the Thurgood Marshall Courthouse, 40 Centre Street, New York, New York. The parties should be prepared to discuss, among other things, the following issues as further set forth in this Order. No later than a week before the scheduled hearing, the parties shall send a joint email to Chambers indicating which attorneys intend to present oral argument. If the scheduled date and time are not feasible for any party, they shall promptly - and no later than May 21, 2024 file a letter motion seeking rescheduling and indicating proposed alternate dates and times that work for all parties in the days surrounding the currently scheduled hearing. Yerian, McKinsey & Company Inc. Un ited States, Dominic Barton, Robert Sternfels, McKinsey & Co., Inc., Mark Hojnacki denying 380 Letter Motion to Compel. ENDORSEMENT: Alix's letter-motion is DENIED, substantially for the reasons set forth above. First, in light of Mc Kinsey's representation that it will "promptly" provide responses to the MIO requests, the first issue is moot (or not ripe, as the case may be). Second, the Court agrees that Alix's interrogatories exceed the number permitted by Fed. R. Civ. P. 33(a) and declines to blessthe excess by retroactively granting leave to exceed the limit. Alix is granted leave to serve new interrogatories, subject to the limit in Rule 33(a), by May 13, 2024.The Clerk of Court is directed to terminate ECF No. 380. SO ORDERED. (Signed by Judge Jesse M.
