TEXT ORDER GRANTING 361 Plaintiffs' Motion for Indicative Ruling on Correction of Clerical Omission and DENYING AS MOOT the parties' request for an expedited briefing schedule. Plaintiffs are correct that the Court inadvertently omitted the word "not" from the sentence identified in 361 Motion. As the surrounding context makes clear, the sentence should have been written as follows: "Finally, to the extent it is admissible at all, the evidence offered by JB7 regarding settlement negotiations does not make this case 'exceptional.'" To the extent the United States Court of Appeals for the Eighth Circuit needs the Court to clarify this in a formal (amended) ruling, the Court would do so if granted jurisdiction via limited remand. Whether remand is even necessary is, of course, up to the Eighth Circuit, as the Court's original intent is obvious even without the formal clarification. Signed by Judge Stephen H.
