ORDER denying 44 Motion for Pre Motion Conference without prejudice and with leave to renew.
The application by Defendants Albert Notarnicola and Champs Gymnastics Corp. (the NY Defendants)and Defendants Justin Bohon and ABC Gymnastics Corp. a/k/a Short Hills Gymnastics (the NJ Defendants) to reinstate the pre-motion conference to address the NY and NJ Defendants' anticipated motions to dismiss, DE 21, DE 23, and the NY Defendants' anticipated motion for summary judgment, DE 24, is denied without prejudice and with leave to renew.
It is clear from the application and Plaintiff's response, DE 45, that Defendants have not made a meaningful effort to meet and confer with Plaintiff prior to filing the within application.
Pursuant to Rule III.d of the undersigned's individual practice rules, entitled, Meet and Confer: "Consistent with Rule 37.3 of the Local Rules, prior to seeking a pretrial conference or filing any non-dispositive pre-trial motions, the parties are to meet and confer in an effort to reach agreement with respect to these submissions or narrow the scope of the request. That is to say, Local Rule 37.3 and the undersigned's individual rules require the attorneys to confer in good faith in person or by telephone in an effort to resolve and/or narrow these issues prior to seeking judicial intervention, including all pretrial matters. Such a meet and confer requires actual human contact as well as a clear indication of the movant's intended application to the court should the meet and confer fail to resolve such issues.
