Text Only Order
** TEXT ONLY ORDER ** Plaintiffs, who reside in New Jersey, are suing a Wisconsin genetic testing company and two of its employees for negligence. Before plaintiffs filed this case, they filed an identical action in state court in New Jersey, which defendants have since removed to federal court. Plaintiffs now move to stay this action pending the resolution of a motion to dismiss for lack of personal jurisdiction in the New Jersey case. Dkt. 15 . When similar actions are filed in multiple forums, the court will generally stay the later-filed action until the earlier one is resolved. See Trafficcast, Inc. v. Pritchard, No. 05-C-557-S, 2005 WL 3002267 (W.D. Wis. Nov. 7, 2005) (citing Warshawsky & Co. v. Arcata Nat. Corp., 552 F.2d 1257, 1263 (7th Cir.1977)). Defendants' only argument against a stay is that personal jurisdiction is lacking in New Jersey, but that is for the New Jersey court to resolve, not this court. The motion for a stay is GRANTED. The parties are ORDERED to file a status report as soon as the New Jersey court rules on the motion to dismiss or every 90 days, whichever comes sooner. Signed by District Judge James D. Peterson on 7/14/2026. (jef)
