   AMENDED ORDER CERTIFYING SETTLEMENT CLASS, PRELIMINARILY APPROVING CLASS ACTION SETTLEMENT, AND APPROVING THE FORM AND MANNER OF NOTICE 408 , 411 by Judge Hernan D. Vera. Plaintiffs have moved under Federal Rules of Civil Procedure 23(e) for an order: (1) preliminarily approving a class settlement on the terms and conditions set forth in the Class Action Settlement Agreement and Release (the "Settlement Agreement"); (2) modifying the class definition that was previously certified by this Court on July 1, 2024 (ECF No. 175), to be consistent with the class definition as set forth herein and in the Settlement Agreement; (3) appointing A.B. Data, Ltd. as Class Administrator; (4) approving forms and the procedures for class notice; (5) setting a deadline of 45 days after the postmark date of the Settlement Notice for class members to opt out or submit written objection; (6) setting a deadline of 60 days after the postmark date of the Settlement Notice for class members to submit claims; (7) scheduling a Final Approval Hearing at the Courts convenience 100 days after the postmark date of the Settlement Notice; and (8) setting a briefing schedule for the Motion for Final Approval and for Class Counsel's application for attorney's fees, costs, and service awards. Terms capitalized herein and not defined shall have the meanings ascribed to them in the Settlement Agreement and directs the parties to perform and satisfy the terms and conditions of the Settlement Agreement that are thereby triggered.
