STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE AS TO DEFENDANT CIBC PURSUANT TO FED R. CIV. P. 41(a)(2): IT IS HEREBY STIPULATED AND AGREED between Plaintiff Harrington Global Opportunity Fund, Limited ("Plaintiff") and CIBC World Markets, Inc. ("Defendant") that, pursuant to a confidential settlement agreement between Plaintiff and Defendant, all of Plaintiffs claims against Defendant in the above-captioned action (the "Action") are dismissed with prejudice, in accordance with Federal Rule of Civil Procedure 41(a)(2), without interest to any party and with each party to bear its own costs, expenses and attorneys' fees and no party to seek any sanctions in the Action as against any other party to this stipulation or any such party's attorneys. Plaintiff's claims in this action against Defendant CIBC World Markets, Inc. are dismissed with prejudice. Each party shall bear its own costs, expenses and attorneys' fees and no party shall seek any sanctions against any other party to this stipulation or against any such party's attorneys. So Ordered.
