STIPULATION OF VOLUNTARY DISMISSAL AND FILING OF AMENDED COMPLAINT: IT IS STIPULATED AND AGREED by and between all parties, pursuant to Federal Rules of Civil Procedure 41(a)(1)(A)(ii), that: (i) Plaintiff voluntarily dismisses Count III (fraud), Count IV (conversion), Count V (constructive trust), and Count VI (attorneys' fees) against all Defendants, with prejudice; (ii) The Vladar Company and Vladislav Yudin are dismissed from this action in their entirety, with prejudice; (iii) Plaintiff shall simultaneously file an Amended Complaint reflecting the foregoing and asserting Count I (breach of contract) and Count II (unjust enrichment)against Generation Iron Brands, LLC only; (iv) Nothing herein modifies or waives any condition, defense, objection, remedy, or right reserved in the Court-endorsed Joint Status Report, including any application under Rule 56 or any claim for costs or fees.
