OPINION & ORDER re: 10 MOTION to Dismiss . filed by Nathan Heltzel. For the reasons set forth above, the Motion to Dismiss is granted insofar as it seeks dismissal of Plaintiff's claim for negligent misrepresentation or conceal ment, but otherwise is denied. As Plaintiff abandoned the negligent misrepresentation claim, the dismissal is with prejudice. See Jennings v. Hunt Cos., Inc., 367 F. Supp. 3d 66, 6970 (S.D.N.Y. 2019) ("[T]he Court considers these claims aband oned and dismisses them with prejudice."); Policemen's Annuity & Benefit Fund of City of Chicago v. Bank of Am., NA, 907 F. Supp. 2d 536, 544 n.8 (S.D.N.Y. 2012) (deeming a claim abandoned and dismissing it with prejudice). For the forego ing reasons, the motions to dismiss are GRANTED in part and DENIED in part. Specifically, Counts One and Four are DISMISSED as to all defendants. Counts Two and Three are DISMISSED only as to the Corporate Defendants, but survive as to the individu al defendant, Sharif Omar. The Clerk of Court is respectfully directed to terminate Dkt.
