ORDER re: 79 80 . Defendant misunderstands the purpose of Rule 26(a) disclosures. It is not to let one's adversary know that there may be people out there with relevant information. That is for interrogatories and document requests. Rather, the purpose of Rule 26(a) is to identify witnesses upon whom a party will be relying in its case in chief. It thus matters not whether the adversary already has detailed knowledge of that witness and the information the witness has; what is important is for the parties to exchange information on who (and on what documents) their adversary is going to rely in making their respective cases.
Except as to Huang (as to whom this Court's prior Order is amended), defendants didn't do that here and they are therefore precluded from relying on the non-disclosed witnesses unless plaintiff deposes them or affirmatively chooses not to in the time frame set by the Court's prior Order.
