The Court further ORDERS, ADJUDGES, and DECREES that Cox post collateral equivalent to Everest's reserves of $27,800,000 to the account designated by Everest within 3 days of this Order. The Court awards Everest costs. This judgment is not final; a separate judgment will resolve Everest's claims against Defendants Cox Oil LLC and Cox Investment Partners, LP at a future date. MEMORANDUM OPINION AND ORDER: The Court GRANTS Everest's motion for summary judgment and ORDERS specific performance from Defendant Bradley Cox under the terms of the Amended Agreement. Specifically, the Court ORDERS Cox to pay Everest $375,382, plus pre- and post-judgment interest, on Everest's claims for relief and also ORDERS Cox to post collateral equivalent to Everest's reserves in the amount of $27,800,000. The Order on collateral is enforceable by contempt. The Court further ORDERS Everest to either (1) file a motion for default within 30 days of this Order because Cox Oil LLC and Cox Investment Partners LP failed to appear in this case or (2) dismiss Cox Oil LLC and Cox Investment Partners LP to make the judgment final.
