Order To Show Cause
ORDER TO SHOW CAUSE: Before the court is Plaintiff Dottie Townson's motion for sanctions and renewed motion to compel the deposition of non-party witness Matthew Lipscomb. (Doc. 38 ). The court meant what it said in its prior order. So the court ORDERS Lipscomb to show cause why he should not be sanctioned for failing to follow the courts June 1 order and appear for his deposition. Lipscomb should deliver a written response to the Clerk's Office at Hugo L. Black United States Courthouse, 1729 5th Avenue North, Birmingham, 35203, on or before July 13, 2026. Failure to respond to this order by July 13, 2026, could result in further sanctions. Because Townson's counsel has been in contact with Lipscomb via text message, the court permits Townson to serve Lipscomb a copy of this order through text message. The court also DIRECTS the Clerk of Court to send a copy of this order to Lipscomb at the address he was served his initial deposition subpoena: 2302 Noccalula Road, Gadsden, AL 35904.
