Motion Hearing Held Order on Motion for Temporary Restraining Order Order on Request for Judicial Notice
MINUTES of Proceedings: This Court held a hearing on Plaintiffs' Second Motion for a Temporary Restraining Order, ECF 88 , and Request for Judicial Notice, ECF 89 . Ruling from the bench and considering the available record, this Court GRANTED both motions. First, the five items identified in Plaintiffs' Request for Judicial Notice are judicially noticeable under Federal Rule of Evidence 201. Second, this Court considered the four TRO factors identified by the Supreme Court's decision in Winter v. Natural Resources Defense Council, 555 U.S. 7 (2008). Based on the record, this Court finds that Plaintiffs are likely to succeed on each of the four factors. Accordingly, this Court ENJOINS the September 9, 2026 gather in Riddle Mountain HMA for fourteen (14) days. This TRO may be extended for an additional fourteen (14) days for good cause. A Preliminary Injunction Hearing is set for September 30, 2026 at 2:00PM in Courtroom 13A. The Government's Response to Plaintiffs' Preliminary Injunction Motion is due September 16, 2026.
