TEXT ORDER granting in part Plaintiff's Rule 36(a)(6) motion to determine sufficiency of Defendant Marine Travelift, Inc.'s ("MTI") answers to Requests to Admit 1, 2 and 4 of Second Set: For the reasons discussed on the record during the hearing, the motion is denied without prejudice as to Request 4 171 . As to Requests 1 and 2, the Court finds that the answers are confusing and that amended answers must be served; that an objection based on Fed. R. Evid. 407 may be preserved but is not a basis for failing to respond; and that a limitation of the scope to the forklift in issue rather than to all/any marine forklift, as set out in the requests, is overruled as the broader scope is relevant and not disproportional. In its amended answers, Defendant MTI may object to terms it deems vague provided that it shall provide its reasonable interpretation and answer based on its interpretation.
