TEXT MINUTE ENTRY for proceedings held before Magistrate Judge Ryan C. Carson on August 4, 2026. Evan Stein appeared for Plaintiff, Jacqueline Tabke appeared for Defendant Walmart, Inc., Patrick Mack appeared for Nominal Defendant ProGro Partners. Plaintiff and Defendant have reached a tentative settlement in principle. ProGro Partners has asserted a claim for reimbursement of workers' compensation payments made to or on behalf of Plaintiff. ProGro represented that the workers' compensation insurance carrier is WCF Insurance.
Plaintiff shall file the anticipated Motion for Distribution Order and accompanying brief on or before August 18, 2026. Response and reply briefs shall be filed in accordance with the Local Rules. See NECivR 7.1. The parties discussed scheduling a half-day settlement conference with counsel and representatives for Plaintiff, Walmart, ProGro, and WCF Insurance participating. Available dates will be provided by chambers, and the conference will be set by separate order. No objection by any party to a representative of Defendant Walmart, Inc. appearing for a settlement conference by phone or video. Time Start: 10:00 a.m.; Time Stop: 10:30 a.m.; Time in Court: 30 Minutes. (CEW)
