This status conference was set to begin at 9:00 a.m., and attorneys for Plaintiff and Defendant Vita Group were present and ready. Mr. Scherer, who is a pro se Defendant, was not present. When Mr. Sherer did not appear at the May 8, 2026 Pretrial Conference, the court struck the conference out of concern that he may not have received notice of the proceeding (Doc.28). Subsequently, the docket was updated to reflect Mr. Scherer's address as the same one at which he been served with process on February 6, 2026 13 , this status conference was set (Doc. 30). Despite two months' notice, Mr. Scherer failed to appear for this proceeding. Calls to Mr. Scherer at the number provided by counsel went unanswered. Additionally, counsel for Plaintiff indicated that despite propounding discovery via FedEx and via email (to an email address previously used for correspondence with Mr. Scherer), Plaintiff has received no response from Mr. Scherer. The Court will set another status conference by separate Order. Each party's appearance is mandatory. (CRD)
