For the foregoing reasons, OJC's Motion for Summary Judgment is granted in part and denied in part. The Court grants OJC's Motion as to MNE's second claim for common counts, but denies summary judgment with respect to MNE's first claim for breach of contract. MNE's Motion for Summary Judgment is also granted in part and denied in part. TheCourt grants MNE's Motion as to OJC's third counterclaim for unfair business practices, but denies summary judgment with respect to OJC's first and second counterclaims for fraudulent inducement and breach of contract.
