Order on Motion for Order of Sale Order on Motion for Hearing/Conference
ORDER The Court has jurisdiction under 28 U.S.C. §§ 1444, 959. Receiver Charles Fredrick's 106 Unopposed Motion for Order Authorizing Sale is GRANTED. The Receiver is hereby authorized to complete the sale of the property located at 89 Sunset Lane, Durango, Colorado (Property) to Feige/Klein on the terms set forth in the Contract.
IT IS FURTHER ORDERED that the Receiver has permission to apply and pay the proceeds from the sale of the Property at closing, and to direct the closing agent to apply and pay such proceeds as follows:
1. First, to any title and sale expenses, commissions, and other amounts reasonably necessary to complete the sale, including the cost of repairs to ready the Property for sale;
2. Second, to any of the Receiver's unpaid fees and expenses in this case, including the Receiver's attorneys' fees, and including a reasonable amount for the Receiver's anticipated costs to file its final accounting and to request termination of his appointment; and
3. The remainder toward satisfaction of the amount owed to Sandia Laboratory Federal Credit Union, now known as Sunward Federal Credit Union (SFCU) under the SFCU's Deed of Trust, in exchange for a release of SFCU's Deed of Trust encumbering the Property.
IT IS FURTHER ORDERED that, after closing, the Receiver shall file a final accounting of all amounts expended and disbursed in connection with the receivership and request termination of his appointment as Receiver.
IT IS FURTHER ORDERED that the Receiver's 107 Motion for hearing is DENIED as moot.
