ORDER. The Court grants the defendants' motion to dismiss in part. The following claims are dismissed with prejudice: Count III, except as to the failure to return or destroy confidential information; Counts VIII and IX; Count X, except as to the passing-off subclaim; Counts XII and XIII; Counts XIV and Count XV, except as to the passing-off subclaims in each count; Count XVI; Count XVII, only as to the rental of a forklift using Polylasts identity; Count XVIII, except as to Polylasts two CFAA claims; Count XIX; and Count XX, except as to the items identified in Dkt.
