   TEXT ONLY ENTRY (IN CHAMBERS) ORDER by Judge Dale S. Fischer. On December 15, 2025, the Court accepted the parties' stipulation to a September 22, 2026 trial date. Dkt. 73 . On December 18, 2025, the Court issued a text only entry providing deadlines for pretrial documents that had not yet been filed. Dkt. 74 . All of those deadlines have expired and none of the required documents have been filed. (Defendants had previously filed a witness list, exhibit list, and memorandum of contentions of fact and law and were not required to refile those documents.) Plaintiff has not provided any pretrial documents: no witness list, exhibit list, or memorandum of contentions of fact and law. Most notably, Plaintiff has failed to file proposed jury instructions and a proposed pretrial conference order. The Court concludes that, once again, Plaintiff has failed to prosecute this case and failed to comply with this Court's orders, the Local Rules, and the Federal Rules of Civil Procedure. The trial date is vacated. Plaintiff is ordered to show cause in writing why the case should not be dismissed for failure to prosecute. The response must be filed no later than September 23, 2026. Failure to file a timely response will result in dismissal. If a response is filed, Defendants' position must be filed no later than October 5, 2026.
