MINUTE ORDER: This case was dismissed on December 2, 2025 pursuant to the parties' Stipulation of Dismissal 34 . "Once a case has been dismissed, a federal court does not retain jurisdiction to enforce a settlement agreement simply on the basis of its prior authority over the underlying dispute." Am. Ctr. for Civ. Just. v. Ambush, 49 F. Supp. 3d 24, 26 (D.D.C. 2014); see Kokkonen v. Guardian Life Ins. Co. of Am., 511 U.S. 375, 378 (1994) ("Enforcement of the settlement agreement ... is more than just a continuation or renewal of the dismissed suit, and hence requires its own basis for jurisdiction."). Accordingly, "where ... a party seeks to enforce a settlement agreement after the district court has dismissed the case, the district court lacks jurisdiction over the agreement unless the court either incorporated the agreement's terms into the dismissal order or expressly retained jurisdiction over the agreement." T Street Dev., LLC v. Dereje & Dereje, 586 F.3d 6, 11 (D.C. Cir. 2009). The court did neither here, suggesting that "Plaintiff['s] attempt to enforce the settlement agreement ... is therefore a new action, which is unmoored from the underlying dispute and requires the filing of a new complaint." DC Soccer, LLC v. CapX Off. Sols., LLC, No. 19-CV-3163, 2021 WL 1061206, at *5 (D.D.C. Mar. 18, 2021). Because the parties failed to address this issue in their briefing, it is hereby ORDERED that the parties shall file supplements of no more than five pages on or before July 28, 2026, addressing the court's jurisdiction to enforce the parties' settlement agreement.
