MINUTE entry before the Honorable Steven C. Seeger: On February 22, 2024, this Court issued an opinion granting in part and denying in part Defendant's motion to dismiss. (Dckt. No. 55 ) The Court concluded that it had subject matter jurisdiction. But the Court concluded that the complaint failed to state a claim. The Court also gave Plaintiff leave to amend, and set a deadline of two weeks. Later, this Court granted Plaintiff's motion for an extension of time. (Dckt. No. 61 ) As Plaintiff requested, this Court extended the deadline to file an amended complaint to March 11, 2024. That deadline came and went over a month ago, and Plaintiff has not filed an amended complaint. So the case is over. The complaint is dismissed with prejudice. Final Judgment Order to follow. MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's motion for an extension of time (Dckt. No. 58 ) is hereby granted. Any amended complaint is due by March 11, 2024. Before Plaintiff takes the time to prepare and file an amended complaint, the Court directs Plaintiff to carefully read this Court's recent opinion on the motion to dismiss. Any claim against the Bank's lawyers faces an uphill battle, for the reasons that this Court previously articulated. Unless Plaintiff could come forward with new authority, it is unlikely that Plaintiff will get a different outcome on the same basic issue. That said, the Court does not know what Plaintiff will allege in an amended complaint, so the Court will keep an open mind in the meantime. Mailed notice. (jjr, ) (Entered: 03/06/2024)
