Status Conference
Minutes of proceedings [non-document] before Chief District Judge Sara Lioi. On September 11, 2026, the Court conducted a telephonic status conference. Attorneys Patrick Moro and Phillip Sornowski participated. Counsel advised that plaintiff had made a demand earlier that day (September 11, 2026), and defendant was considering it. Defense counsel also advised that it planned to file a summary judgment motion on various issues, including liability and the applicability of the statutory damages cap. Counsel further advised that they had participated in some preliminary discussions regarding a possible mediation. The Court expressed its strong interest in resolving the matter, if possible, and instructed defense counsel to contact the Court's law clerk, Michele Schmidt at: Michele_Schmidt@ohnd.uscourts.gov, by September 18, 2026 and advise whether his client would be willing to mediate. The Court indicated that, if the parties are interested in mediation, it may be willing to delay briefing or a ruling on the summary judgment motion. (Court Reporter: None.) Time: 30 minutes. (B,DL)
