Order Striking
PAPERLESS ORDER STRIKING 99 Plaintiff's Notice of Discovery Dispute. The notice fails to comply with 86 Discovery Procedures Order because it does not provide joint availability for a hearing and it far exceeds the scope of information permitted in a notice of discovery dispute. Plaintiff may refile the notice (after further conferral discussed below), but the refiled notice must include the parties' joint availability. Defendants shall cooperate with Plaintiff by providing their availability for a hearing. Though, given that Plaintiff must conventionally file his notice of discovery dispute and must rely on the mail to deliver it, the parties may provide joint available dates outside of the 14-day window described in the Discovery Procedures Order (to account for the fact that it will take some days for the notice to arrive and be filed) if further conferral does not resolve the parties' disputes.
