ORDER noted 170 Case Management Memorandum and Informative Motion. Contrary to Defendants' counsel's assertion, Plaintiff MS Distributors, Inc.'s pending interlocutory appeal to the First Circuit of the denial of the preliminary injunction does not deprive this District Court of jurisdiction over the rest of the case or automatically stay discovery proceedings. See Contour Design, Inc. v. Chance Mold Steel Co., 649 F.3d 31, 34 (1st Cir. 2011)(quoting 11A Wright & Miller, Federal Practice and Procedure § 2962, at 43839 (2d ed.1995)(noting that generally, and absent a stay from the appellate court, an appeal from the denial of a preliminary injunction "does not divest the trial court of jurisdiction or prevent it from taking other steps in the litigation while the appeal is pending."). By July 2, 2026, the parties shall file the joint case management memorandum and exchange mandatory initial disclosures (if they have not done so already). The scheduling conference is RESET for July 16, 2026, at 4:30 p.m. in Hato Rey Courtroom 7 and by video-teleconference. Failure to comply with this Order and with the requirements of the Rule 16 Scheduling Order at CM/ECF 163 may result in the imposition of sanctions. The Court notes that the emails at CM/ECF 170-1 leave much to be desired as neither side cited any legal authority in support of its position in the dispute over this court's jurisdiction.
