Order on Motion to Attach
ORDER OF ATTACHMENT granting 18 Motion to Attach. For these reasons, it is hereby ORDERED that petitioner's Attachment Motion is GRANTED IN PART and DENIED IN PART. It is further ORDERED that, pursuant to Fed. R. Civ. P. 64 and Articles 62 and 75 of the CPLR, the U.S. Marshal for the Southern District of New York, or any person appointed to act in his place and stead, pursuant to CPLR § 6214, is directed to attach any property found within the Southern District of New York belonging to respondent Cape Securities, Inc., up to the value of $528,795.49 in the aggregate. It is further ORDERED that this Order of Attachment is effective immediately and will remain so effective unless or until amended or vacated by this Court. It is further ORDERED that this Order of Attachment is subject to modification, pursuant to CPLR § 6223, including on motion by petitioner, should he return to this Court with sufficient evidence to identify specific property of respondent Cape Securities, Inc. properly subject to attachment by this Court. And it is further ORDERED that petitioner must post a bond in the amount of $500, as security, within 14 days of this Order of Attachment.
