Zilly- Dep Clerk: Laurie Cuaresma; Pla Counsel: Brian Holloway; Def Counsel: Shanece Dedeaux; CR: Debbie Zurn; Time of Hearing: 10:00 AM; TELEPHONIC STATUS CONFERENCE held on 11/14/2023. Counsel advise the Court regarding current status of discovery in this matter. Based on a review of the record and the update provided by counsel, the Court determines this matter cannot proceed to trial on January 22, 2024, as currently scheduled. For reasons stated on the record, the trial date and all pretrial deadlines are STRICKEN; Plaintiff's Amended MOTION to Dismiss for Failure to State a Claim 48 is DENIED, and Plaintiff's MOTION to Compel Mediation 51 is DENIED without prejudice. The Court orders counsel to meet and confer in person regarding outstanding discovery issues no later than November 30, 2023. The parties are ordered to file a discovery plan and cases status report, including proposed dates for trial and all remaining case deadlines, no later than January 5, 2024. An in-person status hearing is tentatively set for 1/12/2024 at 10:00 AM before Judge Thomas S. Zilly. (LC)
