ORDER: As to Plaintiff's requests at ECF Nos. 149 and 150 for the transcript of the 4/23/2026 and 4/30/2026 settlement conferences, the requests are denied. The substance of the 4/23/2026 conference was the possibility of Plaintiff working with a MAP attorney for mediation, and the scheduling of a settlement conference. The Court also heard about Plaintiff's alleged issues with obtaining his file from his former counsel, which the Court addressed in its 4/28/2026 Order. During the off-the-record discussions on 4/30/2026, the Court discussed settlement possibilities with Plaintiff and Defendants' counsel. On the record, the Court discussed trial preparations and other administrative issues, which are memorialized in the 5/1/2026 Order.
In the June submissions, ECF Nos. 149 and 150 , Plaintiff claims that he needs the transcripts because he believes that the Defendants' counsel was not forthright in the settlement process.
The request for the transcripts are denied for the same reasons that the Court previously stated in the 5/22/2025 Order denying the request for the transcript of the 4/30/2026 conference. The Court lacks funds to provide such transcripts, and Plaintiff does not offer any legal basis upon which the Court should grant his request. The issues alleged in ECF Nos. 149 and 150 are irrelevant to the Court given that the settlement discussions were conducted off-the-record and lack any evidentiary value as the discussions did not result in a settlement. Moreover, the Court is unaware of any improper conduct by counsel during the conferences.
