ORDER: At this time, the court will refrain from addressing the state-law claims until it reviews the merits of Count II in light of the Plaintiff's supplemental brief. Based on the foregoing, it is ORDERED as follows: 1) The Plaintiff shall SHOW CAUSE on or before September 17, 2026, as to why Count II should not be dismissed with prejudice for failure to state a claim based on the court's analysis above as to the available post-deprivation remedies. 2) The court will enter a final order on the Defendant's motion to dismiss (doc. 12 ) after receipt of the Plaintiff's brief concerning the procedural due process claim.
