Order Granting in Part the Defendant's Motion for Summary Judgment and Striking the Plaintiff's Cross Motion for Summary Judgment.
IT IS HEREBY ORDERED that AmGuard's motion for summary judgment [ECF No. 27 ] is granted in part as set forth in this order.
IT IS FURTHER ORDERED that Good Fellas' motion for summary judgment [ECF No. 29 ] is stricken.
This case is referred to the magistrate judge for a mandatory settlement conference. If the parties fail to settle, the deadline for their proposed joint pretrial order is stayed until 30 days following the settlement conference; and, within that same 30-day window, AmGuard must file its motion for summary judgment on the breach of contract and bad faith claims pursuant to FRCP 56(f).
