Text Order: Having reviewed counsel's letter [ECF No. 100], and observing that further settlement discussions would not be productive at this time, it is ORDERED: (1) With respect to Plaintiffs' IDEA appeal against Hillsborough, the parties shall proceed first with cross-motions for summary judgment on the administrative record. The proposed briefing schedule (adopted from the parties) is as follows: Opening motions shall be served on October 5, 2026, opposition briefs shall be served on November 4, 2026, and reply briefs shall be served on December 4, 2026. Unless Judge Kiel directs otherwise, the parties shall exchange all briefing prior to filing any motion papers on the docket. Once all papers have been served, movant shall, within 7 days thereafter, file the moving papers, the opposition papers, and the reply papers simultaneously under three separate docket entries. For good cause shown, discovery relating to Plaintiffs' remaining damages claims against Hillsborough, and Hillsborough's counterclaim against Plaintiffs is deferred pending resolution of the cross-motions, as the Court finds that a final ruling on the administrative appeal will substantially narrow the issues remaining for litigation.
