Order on Motion for Reconsideration
ELECTRONIC ORDER denying 811 Motion for Reconsideration Before the Court is Defendant Timothy Barton's Motion for Reconsideration of the Court's Order requiring Barton to seek leave of the Court prior to filing a motion. (Doc. 811 ). As the Court outlined in its previous Order, (Doc. 858 ), Barton has flooded the Court with frivolous, overlapping motions, forcing the Receiver to deplete the Receivership's funds to respond to them. Granting Barton free rein to file anything he wishes would not help the receivership estate or managing judicial resources. The Court DENIES Barton's motion. (Ordered by Judge Brantley Starr on 8/13/2026) (chmb)
Memorandum Opinion and Order
Memorandum Opinion and Order denies 809 MOTION to Release Funds from the Receivership Estate for His Criminal Defense and to Retain Counsel of His Choice. The Court DENIES WITHOUT PREJUDICE the motion and GRANTS Barton leave to refile the motion within fourteen days of the issuance of Magistrate Judge Rutherford's Order on Barton's Motions to Compel the Turnover of Documents. (Docs. 810 , 814 ). (Ordered by Judge Brantley Starr on 8/12/2026) (ndt)
