MINUTE entry before the Honorable John J. Tharp, Jr:Defendant Waukegan Housing Authority's unopposed motion for judgment as to the class 310 is granted. The Court previously recertified the class in this matter "as a Fed. R. Civ. P. 24(c)(4) issues-only class to resolve the issue of whether the Waukegan Housing Authority breached its contractual duties in the manner in which it responded, or failed to respond, to a bedbug infestation at Poe Manor." ECF No. 274. The jury returned a verdict finding the defendant not breach its contractual duties with regard to the infestation. Resolution of that class-wide issue defeats the breach of contract claims belonging to the entire class. As a result, judgment will be entered against the class. Enter Final Judgment Order.
