TEXT ORDER: The Court is in receipt of Plaintiffs' letter dated May 9, 2024, which requests an extension to fact discovery and notes that counsel of record for Plaintiffs is leaving his firm, "which will require Plaintiffs to retain new counsel for this matter." ECF No. 109 . Any requests to withdraw as counsel shall be made through formal motion. And, generally, a corporation whose counsel seeks withdrawal must retain new counsel before withdrawal is permitted. This is because corporate entities may only appear in federal court through a licensed attorney. See Rowland v. California Mens Colony, 506 U.S. 194, 201 02 (1993) (It has been the law for the better part of two centuries... that a corporation may appear in the federal courts only through licensed counsel.) (citations omitted); accord Simbraw, Inc. v. United States, 367 F.2d 373 (3d Cir. 1966); see also Buschmeier v. G&G Invs., Inc., 222 F. Appx 160, 165 (3d Cir. 2007). Because Mr. Bailliard has not been granted leave to withdraw, he remains counsel of record for Plaintiffs. However, in light of Mr. Bailliard's representation that Plaintiffs will be obtaining new counsel, and pursuant to his unopposed request, discovery deadlines shall be extended pursuant to the Eighth Amended Scheduling Order. Plaintiffs shall file a substitution of counsel by no later than June 11, 2024. So Ordered by Magistrate Judge Jose R. Almonte on 5/14/2024. (akw)
