TEXT ORDER: Now before the Court is Defendant's Opposed Motion to Extend Time to File Opposition to 13 Motion for Preliminary Injunction. Defendant is seeking a sixty-day extension of its response deadline so that it can potentially obtain expert testimony necessary to address the 13 Motion. D. 20 at 4. Plaintiff's opposition is not to the extension, but to its length. See D. 22. Claiming that sixty days would cause an unnecessary delay, Plaintiff asks the Court to limit the extension to thirty days. Id. The Court notes, as requested, that Plaintiff's lack of opposition does not constitute a waiver, concession, or admission on its part regarding the preliminary injunction. See Id. at 5. Defendant's 20 Motion is GRANTED in part and DENIED in part. For the reasons stated in Defendant's Motion, the Court finds good cause to extend its deadline to respond to the 13 Motion for Preliminary Injunction. However, given the time sensitive nature of the underlying motion, the Court limits this extension to thirty days. Defendant's response is now due 8/24/2026. Plaintiff also asks that, following this limited extension, the Court hold an evidentiary hearing on the motion for the preliminary injunction. Id. The Court finds such hearing warranted. Thus, an evidentiary hearing on the 13 Motion for Preliminary Injunction is SET for September 3, 2026, at 1:00 p.m. in Courtroom B in Peoria before Judge Michael M. Mihm. Entered by Judge Michael M.
