   ORDER granting in part and denying in part 209 ; granting 210 -- The Court GRANTS Plaintiff's request 210 to electronically file documents under seal. The Court grants in part and denies in part 209 . The Court DENIES Plaintiff's request to amend his Complaint to replead claims that were dismissed at summary judgment. The Court has already given Plaintiff an opportunity to argue why he should be permitted to amend his Complaint at such a late stage in this litigation. (See Electronic Order, dated 5/4/2026). He did not do so. Moreover, the Court does not find good cause to disturb Judge Amons well-reasoned 120 summary judgment decision.

   The Court also DENIES Plaintiff's request for a stay of these proceedings. This matter has been pending for 11 years. This Court has provided Plaintiff with several opportunities since March to file his portion of the Joint Pretrial Order. In light of Plaintiffs current medical situation, the Court will construe 209 as a request for an adjournment of Plaintiff's deadline to submit his portion of the joint pretrial order and the Court GRANTS that request. Plaintiff is given one final extension until October 21, 2026 to file his portion of the joint pretrial order before the Court considers sanctions including dismissal for failure to prosecute.

   The in-person pretrial conference schedule for September 28, 2026, is adjourned to October 23, 2026 at 10:00am. The conference on October 23, 2026 will take place via telephone.    ORDER: Defendant MZ Woodwork, Inc. filed a various Notices of Subpoenas at ECF Nos. 30 to 34 and Affidavits of Service for Subpoenas at ECF Nos. 36 to 39. However, Defendant MZ Woodwork, Inc. is reminded that they may serve discovery materials on Plaintiff, but they may not file discovery materials with the Court unless they seek the Court's involvement to resolve a dispute. Fed. R. Civ. P. 5(d). No dispute is being sought or pending for the Court's resolution regarding the filed documents. (See ECF No. 40.)
