Order Adopting Report and Recommendations Order on Motion for Hearing Order on Report and Recommendations
ORDER ADOPTING REPORT AND RECOMMENDATION: On 9/3/2026, Magistrate Judge Dunst issued a 214 report and recommendation ("R&R") recommending the Court grant the 186 motion for preliminary approval of the class action settlement between plaintiffs and defendants NKCH and Meritas. Objections were due by 9/17/2026 and none were filed. The R&R is therefore reviewed, at most, for clear error. See Fed. R. Civ. P. 72(b), Advisory Committee's Notes (1983); see also, e.g., Alvarez Sosa v. Barr, 369 F. Supp. 3d 492, 497 (E.D.N.Y. 2019).
Having found no clear error in the R&R, the Court adopts Judge Dunst's recommendation in full. The 186 motion is granted. Under the terms explained in the R&R, the Court (a) conditionally certifies the Settlement Class, (b) preliminarily approves the terms of the Class Action Settlement, (c) preliminarily approves the Notice Plan, Long Form Notice, and Summary Notice, (d) defers effectuation of the Notice Plan, (e) designates named Plaintiffs A.J., H.Z., M.Z., G.Z., Michelle Kunde, and Tammie King as representatives for the Settlement Class, (f) appoints Stuart A. Davidson, James J. Pizzirusso, and Jean S. Martin to act as Settlement Class Counsel, (g) appoints Verita Global, LLC as the Settlement Administrator, and (h) shall, at a date and time later selected by the Court, conduct an in-person Final Approval Hearing.
Pursuant to the Court's 12/18/2025 order, all MDL proceedings against NKCH and Meritas remain stayed pending final approval of the proposed class action settlement. Ordered by Judge Rachel P. Kovner on 9/18/2026. (ASG)
